A proposed class action lawsuit against Sam’s Club alleges that its Olivari “100% Pure Avocado Oil” is falsely advertised given that the product is, in fact, adulterated with other oils.

The 15-page false advertising lawsuit contends that despite the defendant’s explicit representation that the product is pure avocado oil, recent testing conducted by scientists at the University of California at Davis revealed that the item “tested impure” and contains other undisclosed oils.
As the class action suit tells it, the alleged misrepresentation leads reasonable consumers to believe that the Sam’s Club product is made with only pure, unadulterated avocado oil, which is considered one of the healthiest cooking oils. Indeed, studies suggest that certain compounds found in avocado oil may reduce blood pressure, cholesterol and joint pain as well as improve heart health, the case says.
However, regardless of consumer perceptions about avocado oil, the issue of whether the product is pure is important to shoppers, who expect to know what type of oil they are buying and consuming, the complaint asserts.
The filing charges that Sam’s Club customers would not have paid as much for the product, or purchased it at all, had they known it did not contain pure avocado oil as represented.
The Sam’s Club lawsuit looks to represent anyone who purchased Olivari avocado oil in the United States within the applicable statute of limitations period.
