A class action filed in New York against HMScreening, Lenders Portfolio, Hickory Energy and others claims the entities violated the Telephone Consumer Protection Act.
A class action filed in New York against HMScreening, Lenders Portfolio, Hickory Energy and others claims the entities violated the Telephone Consumer Protection Act (TCPA) by sending out unsolicited faxes without a TCPA-mandated opt-out notice. Plaintiffs allege the aforementioned companies, as well as HMS Lender Recovery Services and Hickory Management Services, sent out thousands of unconsented advertising faxes. The proposed class covers anyone who has received a fax from the defendants promoting goods or services for sale in the last four years who were not provided with an opt-out notice.
