The 43-page complaint says that on March 30 of this year, KAVX, an electronic component manufacturer, experienced a cybersecurity incident that resulted in the encryption of some of its systems and caused temporary service disruptions. A subsequent investigation revealed that for about six weeks leading up to the March 30 incident, hackers had gained unauthorized access to the company’s systems and stolen sensitive information stored in the impacted servers, the filing shares.
According to the case, the cyberattack exposed the private information of over 39,000 current and former KAVX employees, including their names, addresses, Social Security numbers, dates of birth, employee IDs, employment compensation, financial account numbers, gender identities and handwritten signatures.
The lawsuit alleges that the data breach was a “foreseeable” result of KAVX’s failure to adequately safeguard employees’ data from unauthorized disclosure. More specifically, the complaint claims that the company neglected to employ industry-standard cybersecurity practices and instead maintained sensitive data “in a condition vulnerable to cyberattacks.”
“As a result of the Data Breach, [the plaintiff] and Class Members have been exposed to a heightened and imminent risk of financial fraud and identity theft,” the case says, stressing the “strong probability” that stolen KAVX employee information has already been posted on the black market.
The complaint argues that the 12 months of complimentary credit monitoring services KAVX has offered victims is “insufficient,” given that these individuals will have to pay out of pocket for additional protective measures long after the offer expires.
Despite these serious ramifications, KAVX waited until around October 30 to notify affected individuals of the breach, the suit relays.
The lawsuit looks to represent anyone in the United States whose private information was compromised in the Kyocera AVX data breach that occurred approximately between February 16 and March 30, 2023.
