In a proposed class action out of Arkansas federal court, a consumer alleges that he received from Walmart’s pharmacy unsolicited texts concerning its prescription messaging program.
In a proposed class action out of Arkansas federal court, a consumer alleges that he received from Walmart’s pharmacy unsolicited texts concerning its prescription messaging program.
According to the case, the plaintiff received a two-part automated message from Walmart asking for confirmation to receive automated text message alerts from its pharmacy. The messages supposedly read:
“WalmartRx – 1of 2 – REPLY NEEDED. TO begin receiving automated messages on your prescriptions, please reply YES. To decline reply STOP
WalmartRX – 2of2 – Terms & Conditions at Walmart.com/alerterms Msg & data rates may apply. Reply HELP for help, STOP to unenroll”
The man claims that he was not a customer of Walmart’s pharmacy and never provided the company with prior express consent to be contacted with an automatic telephone dialing system.
