Class Action Filed in Tennessee Claims Forbes Associates Sent Misleading Collection Letter

A proposed class action has been filed against Forbes Associates over allegations that the debt collector sent the plaintiff a misleading collection letter.
A proposed class action lawsuit has been filed against Forbes Associates, Inc. over allegations that the debt collector sent the plaintiff a misleading collection letter in violation of the Fair Debt Collection Practices Act (FDCPA).
The July 2017 letter, according to the case, was seeking to collect a balance of $144.60 plus $86.17 in interest. Despite listing the interest amount, the defendant failed to state the interest rate or the date of accrual, the suit argues, leaving the plaintiff unsure as to whether any payment she sent would satisfy her alleged obligation. Even further, the lawsuit claims the defendant was either not permitted to collect interest at all or was demanding too much interest.
Lastly, the case takes issue with the debt collector’s statement that the plaintiff’s account had been assigned to the company “for immediate collection,” claiming this language overshadows the woman’s right to dispute the debt within 30 days of receiving the letter.
