Class Action Filed Against Venture Solar Over Alleged Telemarketing Calls

A class action claims Venture Solar Capital has placed telemarketing calls to phone numbers listed on the National Do Not Call Registry without consent.

Venture Solar Capital, LLC faces a proposed class action over its alleged practice of placing telemarketing calls to phone numbers listed on the National Do Not Call Registry without obtaining prior express consent to do so.
The 10-page lawsuit alleges the company has run afoul of the Telephone Consumer Protection Act (TCPA), a law that prohibits private entities from placing more than one telemarketing call to a number on the National Do Not Call Registry within a 12-month period without obtaining the owner’s consent.
According to the case, Venture Solar, a solar energy provider who does business in Connecticut, New York and Pennsylvania, relies on telemarketing and door-to-door sales to generate business. The plaintiff, a Pennsylvania resident whose phone number has been listed on the National Do Not Call Registry since 2018, claims to have received two telemarketing calls from Venture Solar on December 30, 2021 despite having never provided prior express consent to be contacted by the company.
Per the case, the first call resulted in the following voicemail being left on the plaintiff’s phone:
“This is Christian from Venture Solar. Hope all is well. I’m just reaching out in response to an inquiry made [sic]. It’s telling you about how much you save with solar energy for your home. I’ve got a quick question for you. So give me a call whenever get this message. Reach me any time at (215) 642-8876. Thanks. I’m looking forward to connecting soon.”
The plaintiff says he never made any inquiry into Venture Solar’s services or provided his phone number to the company.
During a second call on December 30, the plaintiff was offered solar panels and a Tesla battery pack sold by the defendant, the suit continues. Although the representative supposedly did not reveal how he got the plaintiff’s phone number, the lawsuit alleges Venture Solar purchased the number along with other consumer information in order to make telemarketing calls.
The plaintiff further alleges that a day before receiving the telemarketing calls, a Venture Solar representative approached his house as part of a door-to-door sales campaign. According to the complaint, when the representative would not leave his property, the plaintiff called the police and was later told by the officer that the representative had admitted to acting aggressively in his sales pitch and did not possess a required solicitation license from the township.
The plaintiff looks to represent anyone in the U.S. whose telephone number was listed on the National Do Not Call Registry for at least 31 days and received more than one telemarketing call from or on behalf of Venture Solar within a 12-month period within the past four years.
