Delucchi et al v. 21st Century Oncology
Filed: November 8, 2016 ◆§ 8:16-cv-03151-MSS-AEP
A class action has been filed in Florida against 21st Century Oncology Holdings, Inc. over a 2015 breach of its provider database.
A class action has been filed in Florida against 21st Century Oncology Holdings, Inc. over a 2015 breach of its provider database that saw the sensitive personal information of more than 2.2 million patients stolen as a result of the defendant’s “lax security practices.” According to the 55-page complaint, the data theft was not discovered by the defendant until more than a month after it occurred. To make matters worse, the lawsuit alleges, many individuals had no idea the defendant—a third-party “physician-led provider of integrated cancer care services” that operates the largest network of cancer treatment centers in the world—had access to their personal financial and medical data at all.
Perhaps the most damning allegation put forth by the lawsuit is that 21st Century Oncology Holdings had months to work out how to protect patients’ sensitive data and minimize harm, yet did not inform patients of the breach until five months after it happened. The class members, many of whom are or were cancer patients, say the defendants’ negligence has not only put them at risk for identity theft, but has also exacerbated their already life-altering circumstances.
