Eddie Bauer, LLC has been hit with a proposed class action that claims the retailer labels its outlet store merchandise with false reference prices that mislead customers into thinking the items are discounted when they’re actually paying full price.

The “direct to outlet” products in Eddie Bauer outlet stores are advertised through various signage as on sale for a certain percentage off their tagged “reference prices,” the lawsuit out of California says. In reality, however, the products were never sold at the prices listed on their price tags, and the purported price discount, the suit alleges, is merely a “sham” designed to induce customers into making a purchase.
“Eddie Bauer’s deceptive pricing scheme has the effect of tricking consumers into believing they are receiving a significant deal by purchasing merchandise at a steep discount, when in reality, consumers are paying for merchandise at its regular or original retail price,” the complaint asserts.
According to the complaint, Eddie Bauer outlet store merchandise has never been offered for sale at the products’ tagged reference prices.
The lawsuit seeks to cover anyone in California who purchased a “direct to outlet” product at a discount from an Eddie Bauer store anytime since May 7, 2015 and did not receive a refund or credit for the purchase.
