The City of Del Mar, California faces a lawsuit over claims that its parking enforcement officials illegally mark and monitor citizens’ legally parked cars.
The City of Del Mar, California has been hit with a proposed class action over claims that its parking enforcement officials illegally mark and monitor citizens’ legally parked cars without permission to do so.
According to the lawsuit, the city’s parking officials apply chalk marks to car tires to track how long a vehicle has been parked in a particular spot beyond an authorized time limit. This is apparently done without the consent or knowledge of car owners, the suit alleges.
“No law allows these local governments or their parking enforcement officials to mark, touch, place or intrude on a private vehicle without the owner’s consent, unless certain exceptions apply,” the case says, arguing that tagging cars without permission is unconstitutional.
