A lawsuit claims Tesla unlawfully stored the driver's license information of consumers who test drove its vehicles.

A proposed class action lawsuit filed in California alleges Tesla, Inc., Experian Information Solutions, Inc., Appstem Media LLC, and SalesForce Ventures, LLC secretly acquire and store for “marketing and sales purposes” the driver’s license information of consumers who test drive Tesla vehicles. The lawsuit claims that Tesla, under the pretense of verifying potential customers’ licensure, scans consumers’ licenses using an iPad-based app created by defendant Appstem specifically for use by the electric vehicle manufacturer, and, without authorization, automatically transmits this information into the electric car company’s Salesforce marketing database and “other unknown places” for use by Experian and yet-to-be-identified third parties.
Once a prospective customer's license information is disseminated, the lawsuit continues, Experian then unlawfully uses the data to craft a consumer report to create a “Mosaic” score of the consumer's creditworthiness that “Tesla in turn could use, or did use” to target individuals with advertising.
The lawsuit cites alleged violations of the federal Driver’s Privacy Protection Act (DPPA) and Electronic Communications Privacy Act (ECPA), as well as the Fair Credit Reporting Act (FCRA).
