T-Mobile USA, Inc. and Sunrise Communications, Inc. are facing a proposed class action claiming they violated the Telephone Consumer Protection Act by sending text message advertisements to consumers’ cell phones without their prior consent.

T-Mobile USA, Inc. and Sunrise Communications, Inc. are facing a proposed class action lawsuit claiming the parties violated the Telephone Consumer Protection Act (TCPA) by sending text message advertisements to consumers’ cell phones without their prior consent. The plaintiff in the case, whose number has allegedly been on the National Do Not Call Registry since 2003, says he received between six and 10 text messages from Sunrise on behalf of T-Mobile despite never having a business relationship with either of them or providing his written consent to receive the texts.
