Starbucks Corporation is facing a lawsuit filed by a prospective employee who claims the coffee shop franchise unlawfully refused to hire him based on the results of his background check without first providing him with a copy of the report.
Starbucks Corporation is on the receiving end of a proposed class action lawsuit filed by a prospective employee who claims the coffee shop franchise unlawfully refused to hire him based on the results of his background check without first providing him with a copy of the report. The plaintiff alleges that, after a successful interview at Starbucks, he was informed over the phone that he would not be hired based on information found in his background report. Days after the company took “adverse action” against him, the man received a letter containing the report, according to the complaint, which noted two domestic violence convictions by an individual with a similar name who lived in a different state. Because the defendant allegedly failed to provide the plaintiff with his background report before deciding not to hire him, the man was denied his rightful opportunity to correct the inaccurate information in the report, the suit says, an alleged violation of the Fair Credit Reporting Act (FCRA).
