Class Action Claims Six Flags Great Escape Lodge Illegally Charges ‘Hidden’ Fee for Room Reservations

According to the 13-page Six Flags lawsuit, New York’s Arts and Cultural Affairs Law mandates that a “place of entertainment” display the total cost of a ticket before it’s selected for purchase. Under the state law, companies are not allowed to increase ticket prices as customers are in the process of making a purchase, the case relays.
Although customers are initially shown fee-less prices when they visit SixFlagsGreatEscapeLodge.com to book a room, the amusement park operator surprises them at the end of the checkout process with an additional charge, the complaint alleges.
“This hidden charge, which most customers will not discover until they receive a confirmation email with their receipt, is exactly the conduct the law is designed to prevent,” the filing says.
One plaintiff, a New York resident who made an online reservation for the Great Escape Lodge on March 29, 2023, says the defendant illegally charged her a $14.99 “processing fee” that was not disclosed at the start of her purchase.
Per the filing, the plaintiff and other Six Flags customers were required to select the dates they wished to book for a stay, pick a room option and choose optional packages to add to their purchase, all without being notified of the true price of the reservation. In fact, the suit says, even a page displaying the “Grand Total with Taxes” fails to indicate that any other fees will be charged.
The complaint says that only after a consumer reaches the final checkout screen does Six Flags reveal a fee that increases the total room price.
“Even then, the amount of the fees is not disclosed, because it is included in the amount of the taxes charged,” the suit shares. “Only after a customer enters their payment information and clicks the ‘Confirm Reservation’ button to complete the purchase are they provided with an email confirmation that shows the amount of the hidden fee they were charged.”
The lawsuit looks to represent anyone in the United States who booked a reservation for Six Flags Great Escape Lodge from SixFlagsGreatEscapeLodge.com on or after August 29, 2022.
