Samsung Electronics America, Inc. and Samsung Electronics Co., Ltd. are the defendants in a proposed class action over its response to the Note 7 defects.
Samsung Electronics America, Inc. and Samsung Electronics Co., Ltd. are the defendants in a proposed class action that alleges the electronics giant failed to effectively address the much-publicized fire and explosion problems in its Note7 smartphones. The 32-page lawsuit claims that despite repeatedly being made aware of the dangerous issues with its smartphones, particularly with the devices’ lithium ion batteries, Samsung has unlawfully failed to warn buyers of these problems and concealed from consumers that the products are dangerous to use. The case additionally claims that Samsung, despite recalling the Note7, has left other products out on the market that suffer from the same safety issues as the airplane-banned smartphone. From the lawsuit: “While Samsung recalled the Note7, it has failed, and continues to fail, to recall other dangerous products, failed to warn consumers of the dangers they pose, and failed to adequately respond to consumers whose phones have suffered from overheating, fire and explosion.”
