A proposed class action filed in New York claims defendant Optio Solutions LLC, which does business as Qualia Collection Services, violated certain provisions of the Fair Debt Collection Practices Act (FDCPA). The two named plaintiffs behind the action allege the defendant sent them identical collection notices that unlawfully failed to clearly convey the respective amounts of debt owed. Specifically, the defendant allegedly failed to disclose whether the plaintiffs’ balances may increase due to accruing interest and/or fees. This practice, the case says, could lead the unsophisticated consumer to be unclear as to whether paying the stated balance would satisfy the debt.
