Class Action Claims Norwegian Air Owes California Passengers for Canceled, Delayed Flights

A lawsuit seeks damages for a class of flyers who were allegedly not provided contractual 'care and compensation' from the airline for delays, cancelations.
Norwegian Air finds itself as the defendant in a proposed class action lawsuit filed by three plaintiffs who allege the airline failed to uphold its contractual obligation to provide “care and compensation” to a proposed class of California residents whose flights were delayed or canceled.
The lawsuit claims that under Regulation No. 261/2004 of the European Parliament and European Council—EC 261—Norwegian Air is contractually required to pay not less than 600 euros to each passenger whose flight is canceled or delayed by more than four hours. The complaint says EC 261 further stipulates Norwegian Air must remit 300 euros to any passenger whose flight is delayed by more than three, but less than four, hours, as well as provide written notice to passengers of their rights to care and compensation upon a flight being delayed or canceled.
In addition to the aforementioned class of California Norwegian Air passengers, the case also seeks to represent a class of “premium” section flyers whose flights were canceled, and who the defendant placed on alternative flights without providing equal premium service or refunding passengers for related charges.
