NIU of Florida, Inc. is facing a proposed class action lawsuit that takes issue with the defendant’s alleged practice of recording customers’ phone calls without their knowledge or consent.
NIU of Florida, Inc. is on the receiving end of a proposed class action that takes issue with the defendant’s alleged practice of recording customers’ phone calls without their knowledge or consent. Citing potential violations of California state law, the plaintiff claims he was unaware that his February 2018 call to the company’s customer service department was being recorded until he directly asked NIU’s representative during the conversation and was told that all calls are recorded. The case alleges that the defendant failed to include a “warning disclosure” regarding call monitoring/recording at the beginning of the call – a practice the suit insists is unlawful and “highly offensive to a reasonable person” such as the plaintiff.
Originally filed in California Superior Court, the case has recently been removed to the state’s Eastern District.
