Class Action Claims Nearly 400 South Carolina Homes Plagued by Shoddy Roofing Work
Russo et al. v. Eastwood Construction Partners, LLC et al.
Filed: December 9, 2020 ◆§ 2:20-cv-04267
A class action alleges Eastwood Construction Partners, Eastwood Homes and three subcontractors performed shoddy roofing work on nearly 400 South Carolina homes.
Eastwood Construction Partners, LLC Eastwood Homes, Inc. Exterior Contract Services, LLC Southcoast Exteriors, Inc. Alpha Omega Construction Group, Inc.
South Carolina
Eastwood Construction Partners and Eastwood Homes are among the defendants in a proposed class action wherein 30 plaintiffs allege the construction company and general contractor performed shoddy roofing work on nearly 400 South Carolina homes.
The negligence lawsuit claims Eastwood Construction, Eastwood Homes and co-defendants Exterior Contract Services, Southcoast Exteriors and Alpha Omega Construction Group installed on the plaintiffs’ properties defective ridge vents and improperly installed shingle underlayment, roof drip edges, roof shingle fasteners and asphalt shingles using the racking method instead of the offset method.
As a result, the plaintiffs’ Berkley County properties “suffered and will suffer” water intrusion, which can damage wood, drywall and other components, shingle failure, reduced useful life of the roofs and expenses related to roof repairs, the complaint says.
According to the lawsuit, the proposed class may be composed of 388 homes whose roofing work was done by the defendants.
Per the suit, Eastwood Construction and Eastwood Homes built and were general contractors for the plaintiffs’ properties, and engaged subcontractors Exterior Services, Southcoast and Alpha Omega to handle the roofing work. The lawsuit contends the defendants owed the plaintiffs a duty to “complete the work free from defects, in a good and workmanlike manner, and in accordance with all applicable laws, building codes, industry standards, manufacturer’s installation instructions, and standard of care.”
The suit stresses the plaintiffs will be forced to spend “substantial sums of money” to address the alleged roofing issues and damage done to non-defective components of their properties.
Initially filed the Charleston County Court of Common Pleas, the lawsuit was removed to South Carolina District Court, Charleston Division, on December 9.
