Louis v. Nature's Path Foods USA Inc.
Filed: May 1, 2019 ◆§ 1:19cv2584
A lawsuit claims Nature’s Path misrepresents the amount and quality of the acai berries in its Frosted Wildberry Acai Toaster Pastries.
New York
Nature’s Path is on the receiving end of a lawsuit that claims the food company misrepresents the amount and quality of the acai berries in its Frosted Wildberry Acai Toaster Pastries.
According to the proposed class action, the pastry’s box depicts images of several acai berries along with a single strawberry, raspberry and blueberry. Based on the packaging, consumers expect the pastry to contain a meaningful amount of acai, and for the berry to be in the same puree form as the other fruit ingredients, the case argues. Despite these representations, however, the pastry apparently contains a smaller amount of acai than all other fruit components. Additionally, the acai is not used as a puree like the other fruit, but is used instead in its powdered form, which has significantly fewer health benefits, the case says.
The complaint argues Nature’s Made uses these alleged misrepresentations to sell the pastries at a higher price than similar products.
