Missry et al v. Donisi Jax, Inc.
Filed: June 21, 2018 ◆§ 1:18cv3614
Donisi Jax, Inc. is facing a consumer's claims that the company placed unlawful telemarketing calls to her cell phone after she requested that it stop calling.
New York
One of the plaintiffs in the case says she contacted the defendant, which does business as Nationwide Health Advisors, to inquire about health insurance for her husband, the second named plaintiff. She ultimately decided she was not interested in the defendant’s products, according to the lawsuit, but began receiving automated telemarketing calls from the company thereafter. The woman claims she requested that the defendant stop calling her on multiple occasions, even going so far as to set up an automatic “do not call” message on her phone that would be sent to Donisi Jax when she received a call from the company, but the calls supposedly continued. According to the lawsuit, the plaintiff received “dozens of calls” from the defendant in violation of the Telephone Consumer Protection Act.
