Class Action Claims Monsanto Enzyme Targeting Claims Are Deceptive

Two plaintiffs have filed a class action that alleges Monsanto deceived consumers with statements about an enzyme purportedly targeted by its Roundup weed killer.
Two plaintiffs have put their names on a proposed class action that alleges glyphosate, the main ingredient in Monsanto Company’s Roundup “Garden Weeds” Weed & Grass Killer, does target an enzyme found in humans and pets, even though the products are labeled and advertised otherwise. From the lawsuit:
“The false statement regarding glyphosate and the enzyme is material. There is widespread controversy and concern around glyphosate and its risks. Studies indicate that the health of the beneficial bacteria in our bodies is directly linked to our general health. Studies also suggest that glyphosate may be carcinogenic and affect human and animal cardiovascular, endocrine, nervous, and reproductive systems.”
The plaintiffs say defendant Monsanto’s false statement was made with the goal of selling more Roundup products and to justify charging consumers more than they would have otherwise paid for the weed and grass killer. But, the complaint argues it’s not so much what the statement says as what Monsanto allegedly chooses to omit:
“In light of this controversy, and to assuage concerns about glyphosate’s risks to health, Monsanto markets Roundup Garden Products with the false statement that they target an enzyme that is not found in people or pets,” the plaintiffs allege. “Monsanto omits material, contrary information, namely that human gut bacteria produce and utilize the enzyme targeted by Roundup Garden Products.”
