Ortiz v. Monarch Recovery Management, Inc. et al
Filed: November 6, 2018 ◆§ 2:18cv4782
A consumer claims that Monarch Recovery Management misrepresented her debt by falsely implying that her account balance could increase.
Pennsylvania
Monarch Recovery Management, Inc. is the defendant in a proposed class action that claims the company misrepresented a consumer’s debt by falsely implying that her debt amount could increase.
Filed in Pennsylvania federal court, the lawsuit centers on a letter sent to the plaintiff in July 2018 concerning an obligation allegedly owed to Synchrony Bank. The suit says the letter stated, in part:
“Total Balance as of 16 JUL 2018: $918.38
As of the date of this letter, you owe $918.38”
The case argues that the notice falsely suggested that the woman’s debt amount “was not static and would increase over time” in that it listed three separate times the balance due “as of” the date the letter was sent.
