A proposed class action recently removed to Kentucky federal court alleges consumers who dined at two Boyd County Waffle House locations may have been exposed to the Hepatitis A virus.

A proposed class action recently removed to Kentucky federal court alleges consumers who dined at two Boyd County Waffle House locations may have been exposed to the Hepatitis A virus. Filed against Waffle House, Inc.; Riverside Restaurant Group, LLC; WH Capital, LLC; and one or more presently unknown Waffle House employees, the case alleges that between February 12 and February 28, 2018, a restaurant worker infected with Hepatitis A prepared or served food that was exposed to the virus, causing it to become “adulterated and unsafe for consumption.”
On March 6, 2018, the complaint continues, the county’s Department of Health issued a Public Health Alert warning individuals who may have been exposed to the disease to seek post-exposure treatment within two weeks.
The plaintiffs claim the defendants’ negligence allowed customers to be served food that was “unreasonably dangerous” and required them to receive vaccinations, IG shots, or blood tests as a result.
