Class Action Claims Jaguar Land Rover North America Secretly Collects, Sells Driver Data Without Consent

The 24-page privacy lawsuit claims the automaker has failed to disclose to drivers that it captures and shares their personal information, which it collects through software features, such as InControl, that have been integrated into numerous Jaguar Land Rover models since 2014.
Although the technology is touted as a way to “enhance the driving experience,” the software allows the automaker to track a variety of metrics about a driver’s behavior, including the location of their vehicle and data about acceleration, hard braking or high-speed events, the suit explains. The features can even transmit details about Bluetooth calls and music being played in the car, the case adds.
The complaint contends that the company then quietly sells the harvested information to third-party credit agencies or data aggregators, which, in turn, provide the consumer data to automobile insurance companies, among others. According to the filing, these auto insurers “can and do use the data” to raise quotes and insurance premiums.
As the suit tells it, the defendant does not properly inform drivers that some or all of their personal information will be tracked and furnished to third parties, potentially resulting in higher insurance premiums.
“The net result is every entity in this series of transactions is profiting from the sale of drivers’ data, while drivers themselves not only do not see a penny from the sale of their own data, but often see their insurance quotes or premiums inexplicably go up,” the case argues.
The plaintiffs, two Massachusetts residents, claim they are victims of the allegedly exploitative data collection practices of Jaguar Land Rover. The drivers say that the software built into their 2023 Land Rover Defender 110 has allowed the company to capture and sell their personal information without their knowledge or authorization.
The Jaguar Land Rover North America lawsuit looks to represent any driver whose Jaguar Land Rover vehicle recorded some or all their data and shared it with and/or sold it to third parties.
