A 'tester' claims in a lawsuit that transport services offered by Island Hospitality Management hotels violate the Americans with Disabilities Act.

The plaintiff in a proposed class action filed in Pennsylvania alleges hotels run by defendant Island Hospitality Management, LLC are out of step with the Americans with Disabilities Act (ADA) due to their alleged failure to make transportation services fully accessible to individuals with disabilities. The plaintiff—who the case says uses a wheelchair for mobility and is considered a “tester” of companies’ ADA-subject services—claims the shuttle services offered by the defendant’s hotels are not wheelchair accessible. The plaintiff, moreover, claims the defendant “would not provide an alternative transportation service.”
“The investigation performed on behalf of [the plaintiff] further confirmed that, in addition to the Hyatt Place, [the defendant] managed and/or operates a substantial number of other hotels in the United States that offer transportation services to their guests, but do not offer equivalent transportation services to guests who use wheelchairs or scooters,” the complaint reads.
The lawsuit names 30 of the defendant’s hotels across Texas, Pennsylvania, New York, Massachusetts and California that allegedly do not offer ADA-compliant transportation services.
