The makers of Goli Nutrition Ashwagandha Gummies face a proposed class action that claims the dietary supplement provides none of the advertised sexual, weight loss, physical performance or cortisol management benefits.

The 34-page complaint against Goli Nutrition Inc. and Better Nutritionals LLC says that although the companies have touted the gummies as “clinically proven” to help “relax, restore and unwind” by helping maintain “normal cortisol levels,” the product’s two active ingredients, KSM-66 ashwagandha root extract and vitamin D, do not provide any of the advertised health benefits.
According to the lawsuit, scientific studies have shown that ashwagandha does not help with sexual function. Moreover, the defendants’ claims with regard to the gummies’ weight loss benefits are “extremely worrisome” given consumers may forgo professional help in favor of taking the supplement, the suit says.
Similarly, studies have shown that the defendants’ endurance-enhancing claims are “ill-founded” given there exists little conclusive evidence that vitamin D supplementation can help physical performance, the lawsuit says.
The filing relays that the National Advertising Division (NAD), an independent nonprofit that evaluates the truth and accuracy of national advertising, expressed concern with “several methodological flaws” in the defendants’ studies on ashwagandha and vitamin D that “undermined the reliability” of the companies’ representations. Per the suit, the NAD recommended that the defendants “modify or discontinue their claims” about the Goli gummies’ efficacy with regard to sexual function benefits, weight loss and weight management and physical performance improvement.
“Had Defendants not made the false, misleading, and deceptive representations and omissions, Plaintiff and the Class Members would not have been willing to pay the same amount for the Product they purchased and, consequently, Plaintiff and the Class Members would not have been willing to purchase the Product,” the lawsuit alleges.
The suit looks to cover all consumers who bought Goli Nutrition Ashwagandha Gummies in the United States within the applicable statute of limitations period.
