Dobberstein Law Firm, LLC is on the receiving end of a proposed class action lawsuit filed in Wisconsin over the debt collector’s alleged failure to notify a consumer that the amount of her debt was increasing over time.
Dobberstein Law Firm, LLC is on the receiving end of a proposed class action lawsuit filed in Wisconsin over the debt collector’s alleged failure to notify a consumer that the amount of her debt was increasing over time. The plaintiff says she received a collection notice (Exhibit A) on January 26, 2018 that stated the amount she supposedly owed but neglected to mention that her balance was accruing interest as specified by the woman’s original agreement with her creditor.
Because of the supposed omission, the lawsuit states, the plaintiff “would have no way of knowing” whether any payment she submitted would resolve her account. As stated in the complaint:
Dobberstein’s failure to include explanatory safe harbor language in Exhibits [sic] A is material because the unsophisticated consumer may pay the amount listed on Exhibit A, but the payment would not actually resolve the debt.”
