According to the 21-page case, Your Signature Supplements has violated state and federal law by falsely advertising Dementia/Alzheimer’s Support as capable of effectively improving cognitive function, reducing symptoms of memory loss and preventing Alzheimer’s disease and dementia. In truth, the product cannot deliver these advertised benefits, “nor any results at all,” the lawsuit claims.
What’s more, the defendant was prohibited from representing that its supplements can cure, mitigate or treat the conditions without FDA approval, the filing says. Such label claims render Dementia/Alzheimer’s Support a “drug” within the meaning of the federal Food, Drug, and Cosmetic Act, the suit relays.
As such, the case alleges that Your Signature Supplements’ illegal sale of an unapproved drug misleads consumers into believing that the product is safe and effective for its intended use.
The filing shares that in a February 2019 press release, FDA Commissioner Dr. Scott Gottlieb warned against “health fraud scams” that prey on vulnerable populations by making unproven drug claims about treating “serious and complex diseases like Alzheimer’s,” which has no cure.
The complaint stresses that the sale of drugs that have not been reviewed by the FDA for safety, effectiveness or quality puts buyers at risk.
“First, consumers risk purchasing and using a product that will endanger their health,” the case says. “Second, consumers risk purchasing a product that will not effectively treat their condition, forgoing actual treatment of that condition in lieu of an unapproved new drug which may not treat their condition.”
Overall, the case claims that the Dementia/Alzheimer’s Support supplements are misbranded and have a “value of $0.”
The lawsuit looks to represent anyone who purchased Dementia/Alzheimer’s Support in the United States for their own personal or household use, and not for resale, since January 1, 2015.
