A new class action out of New York claims Credit Control & Collections, LLC ran afoul of the Fair Debt Collection Practices Act (FDCPA) by leaving phone messages for consumers without expressly identifying that the call was from a debt collector. The plaintiff claims the defendant left messages on numerous occasions that uniformly failed to specify that the call was from a debt collection agency. Such deceptive behavior could cause the unsophisticated consumer to unwittingly provide personal information to obtain the identity of who called, the FDCPA outlines.
