An FDPCA lawsuit claims Cheadle Law attempted to collection 'attorneys fees' not allowed by law.
A proposed class action out of Tennessee claims Cheadle Law sent the plaintiff a collection notice that misled the woman into believing she, due to a pending lawsuit, was under a legal obligation to pay $1,355.94 in “attorney fees” sought by the defendant. The lawsuit alleges the Cheadle Law’s ostensible misrepresentations in the notice violate the Fair Debt Collection Practices Act (FDCPA) in that they constitute the defendant attempting to collect an amount impermissible by law.
