Buxbaum v. Central Credit Services LLC
Filed: August 11, 2017 ◆§ 1:17-cv-04724
Debt collector Central Credit Services allegedly failed to include certain legally required details about the plaintiff's balance in a collection notice.
New York
A New York consumer is behind a proposed class action against Central Credit Services LLC that alleges the debt collector unlawfully failed to provide necessary details about his “current balance,” namely whether the amount was subject to accruing interest and/or fees. According to the plaintiff, his balance was subject to increasing interest, per his contract with her original creditor. Despite this, the case continues, the defendant’s alleged failure to disclose if the debt would increase due to additional fees left the plaintiff, i.e. “the least sophisticated consumer,” unsure as to whether payment of the amount stated in the notice would fully satisfy his debt.
