Carter-Young, Inc. is the defendant in a proposed class action alleging the debt collector failed to fully inform a consumer of her rights under the Fair Debt Collection Practices Act (FDCPA). According to the lawsuit, the FDCPA requires that debt collectors include specific disclosures in their communications with debtors, including information concerning their right to dispute alleged debts.
Though the defendant purported to set forth the plaintiff’s dispute rights, the case claims the letter was missing required information. The notice supposedly informed the plaintiff that upon receiving written notification of a dispute, the debt collector “will obtain verification of the debt or obtain a copy of a judgment or verification.” What the letter failed to mention, the suit argues, was that the defendant was required to mail the plaintiff a copy of the “judgment or verification” after obtaining it. The case claims the defendant’s letter constituted “an unfair or unconscionable means to collect or attempt to collect a debt” and failed to meet the FDCPA’s strict requirements concerning debt collection.
