Class Action Claims Behr’s ‘DeckOver’ is ‘Worse Than Cheaper Options’

Behr is facing a class action that alleges its DeckOver deck and patio coating product was deceptively marketed and performs worse and fails sooner than cheaper products.
A proposed class action filed in California alleges Behr unlawfully misrepresented its DeckOver product as being more durable and longer-lasting than ordinary paints and stains. The complaint argues that despite Behr’s marketing of its patio and deck product, DeckOver, which is sold exclusively at Home Depot, begins to “flake, peel, and separate” from deck and concrete surfaces within months of application. Without mincing words, the 31-page lawsuit says defendants Behr Process Corp., Behr Paint Corp. and Masco Corp.’s product is simply not worth its premium price.
“Thus, rather than providing homeowners with a premium option for reducing maintenance work and improving the look and performance of their patios and decks, DeckOver performs worse than cheaper options and requires hours of scraping, scrubbing, and sanding to remove it (with some homeowners resorting to replacing their decks entirely,” the lawsuit scathes.
The complaint further alleges Behr made a practice of suppressing negative reviews of its DeckOver product on its website, and even went so far as to “stuff the ballot box” by placing fabricated positive reviews on its website to balance out the negative remarks.
The case covers a proposed nationwide class of consumer who purchased Behr’s DeckOver product, as well as an Ohio-only subclass.
