A proposed class action alleges Ancient Organics LLC has falsely and misleadingly labeled its Eat Good Fat products in an effort to convince the public that the ghee, i.e., clarified butter, is nutritious and healthful to consume.
The 43-page lawsuit says that although Ancient Organics touts its ghee as a “superfood” that’s the “very best fat one could eat,” the product, in truth, contains a high amount of unsafe saturated fat that increases the risk of coronary heart disease and other health issues. Further, the case alleges Ancient Organics includes certain health-focused nutrient content claims on product labels without disclosing that the ghee contains high levels of saturated fat or the risks of consuming the clarified butter.
Per the suit, reasonable consumers would not have bought the Ancient Organics product, or would have done so on different terms, had they known that the company misrepresented that the ghee was healthy and a healthier alternative to competing items.
According to the filing, Ancient Organics touts the ghee—rich clarified butter that has been simmered and strained to remove all water—as able to “nourish the mind, body, and soul” and containing Omega 3, 6 and 9 and vitamins A, D, E and K. The company does not disclose alongside these nutrient claims, however, that the ghee contains high levels of saturated fat, the suit says.
“The majority – 64% – of the fats contained within the Product are saturated fat,” the case claims, adding that one tablespoon of the ghee contains nine grams of saturated fat, roughly equivalent to the amount of saturated fat in three large orders of McDonald’s fries.
The lawsuit adds that the consumption of saturated fat negatively affects blood cholesterol levels, specifically by raising the levels of low-density lipoproteins (LDL), known as “bad” cholesterol.
Overall, the Ancient Organics ghee is misbranded under California and federal law given it is labeled with statements that suggest or imply that it is healthful, conducive to health and not detrimental to health, the lawsuit argues.
The suit looks to represent consumers nationwide who purchased Ancient Organics ghee in the United States within the applicable statute of limitations period.
