Class Action Claims AmeriPride, Aramark Excessively Increased Rental Service Prices Without Notice

A class action alleges AmeriPride Services and Aramark have breached their contracts with customers by raising base prices by more than six percent without advance notice.
A Corona, California cake maker alleges in a proposed class action that AmeriPride Services and Aramark Uniform Services have breached their contracts with customers by raising base prices for rental services by more than six percent without advance written notice.
According to the 11-page lawsuit, the contracts used by AmeriPride and/or Aramark for linen, towel, floor mat, uniform and apron rental services stipulate that if the companies feel a base price increase of more than six percent is necessary, they will notify a customer in writing prior to imposing the price increase. The suit also says that the defendants’ contracts allow for a customer to give the companies notice within 10 days of their rejection of a more than six-percent price increase.
The plaintiff alleges that contrary to their contractual language, AmeriPride and Aramark have systematically and without advance notice increased base prices in excess of the contractually permitted percentage, in fact “as high as 30%,” per the case. The price increases alleged by the plaintiff were purportedly done through the defendants’ regular invoicing, without an opportunity for the business to reject the increase, the case claims.
“Accordingly, Defendants unilaterally implemented base price increases exceeding the allowed percentage without complying with their own contractual requirement for such price increases,” the filing claims.
The lawsuit looks to cover all AmeriPride and Aramark customers nationwide who, within the applicable statute of limitations period to the present, were parties to a contract and who were subject to one or more base price increases in excess of the contractually allowed percentage and were not first notified of the increase in writing.
