Circle K Stores, Inc. has been named as the defendant in a proposed class action that accuses the convenience store chain of sending automated text messages to consumers without securing prior consent to do so.

According to the case out of Arizona, the gas station and convenience store chain attempts to persuade consumers to sign up for its “Easy Rewards” program by using automated dialing technology to send unsolicited text messages to potential enrollees. The plaintiff says he received the following message from Circle K in September 2019:
The lawsuit argues that Circle K sends its telemarketing messages without securing recipients’ prior express written consent to do so—an alleged violation of the Telephone Consumer Protection Act.
The plaintiff says he and the “thousands” of others who may have received the messages were “harmed in the form of annoyance, nuisance, and invasion of privacy.”
