Northstar Location Services, LLC finds itself as the defendant in a proposed class action in which the plaintiff alleges she received a collection notice from the company that contained “material omissions” of fact.
The lawsuit says the plaintiff received a letter from Northstar in April 2018 over an obligation supposedly owed to Bank of America. According to the case, the woman’s debt was time-barred, meaning neither the defendant nor Bank of America could sue the plaintiff over the account—a fact the defendants supposedly left out of the notice. The detail omitted from the letter, the suit goes on, is materially deceptive in that an unsophisticated consumer would believe the two entities did, in fact, have the option to bring litigation to recover the amount supposedly owed. Moreover, the communication allegedly failed to point out that payment from the plaintiff would effectively reset the debt’s statute of limitations.
