From Arizona comes a proposed class action filed against Seidberg Law Offices, P.C. over alleged violations of federal debt collection law. The plaintiff, a Phoenix resident, claims he received two collection notices from the defendant in January 2018. The second notice stated, in part:
We have tried to contact you in order to resolve the debt owed by you to our Client. We want to do so without the need for litigation, but unfortunately, we still have not heard from you and this matter remains unresolved.The lawsuit alleges the defendant overstepped the Fair Debt Collection Practices Act (FDCPA) in threatening legal action against the plaintiff while urging the man to make immediate arrangements to pay his obligation. More specifically, the defendant’s statements in the notice allegedly overshadowed the plaintiff’s FDCPA right to dispute and request verification for the debt within a 30-day time period from receipt of the first notice.
Unless we hear from you now, we can only assume that you are refusing to voluntarily address this matter. While it is not our wish to do so, failing to hear from you, we will be compelled to sue.”
