A proposed class action claims that CAC Financial Corp. “bombarded” a consumer with automated phone calls concerning the collection of a debt that belonged to someone else.
Filed in Oklahoma federal court, the lawsuit alleges the defendant employed an “aggressive contact schedule” of placing multiple daily calls to and leaving voicemails for the plaintiff regarding a debt she did not owe. According to the case, the plaintiff “advised CAC on multiple occasions” that she was not who they were trying to contact yet nonetheless continued to receive additional calls and messages. The suit says the defendant’s calls were placed using an automatic telephone dialing system to the woman’s phone “without her consent and over her explicit objection.”
