Class Action: Boston Scientific Placed Unauthorized Robocalls to Market Spinal Device
Sandoe v. Boston Scientific Corporation
Filed: August 26, 2018 ◆§ 1:18-cv-11826
A class action suit claims Boston Scientific Corporation unlawfully placed unsolicited, prerecorded robocalls to consumers.
Massachusetts
From Massachusetts comes a proposed class action in which the plaintiff claims Boston Scientific Corporation unlawfully placed unsolicited, prerecorded calls to consumers without first obtaining proper consent to do so. Citing potential Telephone Consumer Protection Act (TCPA) abuses, the complaint claims the defendant, a medical device manufacturer, placed two unauthorized calls to the plaintiff in July 2018 to promote its Spectra WaveWriter spinal cord stimulator. Boston Scientific failed to obtain express written consent before placing the calls to the plaintiff, whose number is included in the National Do Not Call registry, the lawsuit claims.
