Atlantic Credit & Finance Inc. has been sued by a Wisconsin consumer who claims the debt collector sent a letter that left the woman uncertain as to the identity of her creditor.
The case centers on a September 2018 collection notice in which the defendant listed Synchrony Bank as the original creditor and Midland Funding as the current creditor. The suit says the letter also stated:
“Our records reflect you are obligated on the Account which is in default. Accordingly, Atlantic is entitled to be paid the balance due of $1,388.97.”
By stating that the defendant was entitled to payment while simultaneously naming Midland Funding as the current creditor, the notice allegedly confused the plaintiff as to who she owed money to.
