Class Action Argues WindsorONE Trim Board Can Prematurely Decay, Rot

Windsor Surry Company, which does business as WindsorONE, is facing a proposed class action that alleges some of the its trim board products are defective.

Windsor Surry Company, which does business as WindsorONE, is one of three defendants in a proposed class action that alleges some of the company’s WindsorONE and WindsorONE+ Protected trim board products can prematurely deteriorate and decay, which the lawsuit claims can cause significant property damage. The case against WindsorONE and co-defendants Windsor Willits Company (which does business as Windsor Mill) and Windsor Holding Company claims the affected trim board products suffer from three common defects, each of which can lead to wood rot:
- A failure to use a rot-resistant wood;
- A failure to use a preservative to deter wood rot; and
- A failure to use a waterproof adhesive
According to the 53-page complaint, the defendants sold “millions of linear feet” of their faulty trim board product at a “premium price over other trim board materials” on the back of claims that WindsorONE trim board has superior durability and performance in exterior applications. The defendants allegedly knew of and actively concealed the WindsorONE rot defect “for decades” from consumers and construction professionals alike.
