American Fire and Casualty Company faces a lawsuit that claims the insurer wrongly denied a dentist's property damage claims in the midst of the COVID-19 pandemic.
A dental practice has filed a proposed class action lawsuit against American Fire and Casualty Company over its alleged denial of the business’s claims for damages sustained after being forced to close due to the COVID-19 pandemic.
According to the 15-page lawsuit out of Washington, the plaintiff’s “commercial protector” policy and related endorsements purports to cover direct physical loss or damage to the dental practice’s property. The plaintiff argues that after Washington Governor Jay Inslee issued several executive orders limiting the ability of certain healthcare providers and non-essential businesses to operate, the plaintiff business suffered damage that should have triggered coverage under its insurance policy’s business interruption, extra expense, interruption by civil authority, and other expenses coverage.
The suit alleges that although the plaintiff submitted an insurance claim to American Fire and Casualty Company after being forced to close, the defendant denied its claim.
The case against American is one of the latest in a series of litigation filed against commercial insurers in the wake of the COVID-19 crisis.
