Mcateer v. Target Corporation
Filed: February 7, 2018 ◆§ 0:18cv349
A consumer claims Target's makeup remover has caused hundreds of thousands of consumers to experience allergic or strong irritating reactions.
A California woman alleges in a proposed class action lawsuit that Target Corporation’s Up & Up Makeup Remover Cleansing Towelettes – Evening Calm have caused hundreds of thousands of consumers to experience allergic or strong irritating reactions, including deep burning sensations and blotchy and swollen skin. Filed in Minnesota, Target’s home state, the 45-page complaint outlines allegations that the company’s representations of its makeup remover, such as claims that its “ultra-soft cloths” gently remove makeup and contain ingredients comparable to a similar Neutrogena product, are outright false.
The plaintiff charges that Target failed to properly warn consumers in any of its advertising and marketing that they could experience injury from using the makeup remover towelettes, not to mention that the product contains at least six ingredients, including undisclosed fragrances, that are known irritants.
The lawsuit proposes to cover a nationwide class of consumers and an additional California-only class of those who purchased Target’s Up & Up Makeup Remover Cleansing Towelettes – Evening Calm.
