A proposed class action claims mattress retailer Purple Innovation has misled shoppers by listing products online with fictitious original prices and fake corresponding discounts, creating the illusion of a bargain.

According to the 19-page lawsuit, Purple Innovation intentionally inflates its products’ reference prices to trick consumers into believing they are getting a deal on mattresses that are of a higher quality and market value than they truly are. The suit alleges that this is no more than a deceptive sales strategy, as the company’s products are never sold at their purported original prices.
“Such findings were confirmed through online archives documenting Defendant’s pricing and sale history,” the filing claims.
When a shopper views a mattress that is allegedly “on sale” on Purple.com, they are shown a false “strikethrough” price alongside a purported discount price, the case shares. The company prominently displays the corresponding savings the consumer will supposedly receive thanks to the apparent “sale,” the complaint adds.
As such, consumers are misled to think they are getting a bargain, a means for Purple to induce them into making a purchase they otherwise would not have made, the filing charges.
Federal and state law plainly prohibit companies such as Purple Innovation from making false or misleading statements with respect to product price reductions, the lawsuit points out. Nevertheless, the company has “[taken] advantage of [consumers’] trust” and misrepresented the quality and value of its mattresses in order to bolster sales, the suit claims.
The plaintiff, a San Francisco consumer, says he ordered in June 2023 a queen-size mattress for $1,299, purportedly on sale from $1,399. The man contests that he would not have paid as much for the mattress, or bought it at all, had he not been deceived by the false reference price.
The lawsuit looks to represent anyone who purchased a Purple Innovation product in California at any time during the applicable statute of limitations period.
