Gaines v. General Motors Company et al
Filed: July 5, 2017 ◆§ 3:17-cv-01351-BTM-BGS
A class action filed in California takes issue with an alleged defect in some 2010-2013 Cadillac SRX models that can cause sunroofs to leak.
A consumer in California alleges in a proposed class action that General Motors Company should be on the hook for a sunroof defect found in some 2010-2013 model year Cadillac SRX vehicles that can cause water to leak into the passenger compartment. The alleged defect can lead to mold growth and even damage the vehicles’ electrical wiring and sound deadeners, the lawsuit claims.
Additionally, GM has allegedly denied warranty coverage to vehicles experiencing the problem, instead leaving owners and lessees out to dry for the cost of repairs and replacement parts. The plaintiff argues GM’s bumper-to-bumper limited warranty, in truth, covers a vehicle from the date it was delivered for either four years or 50,000 miles, as well as any defect related to materials or workmanship.
The complaint estimates more than 222,000 vehicles delivered between 2010 and 2013 may be affected by the alleged sunroof defect.
