Barstool Sports, Inc. is the defendant in a proposed class action lawsuit filed in New York that alleges the company's website, BarstoolSports.com, contains access barriers that unlawfully discriminate against deaf and hard of hearing users. The 23-page civil rights lawsuit, more specifically, alleges the audio portions of videos found on BarstoolSports.com are “impossible for deaf and hard of hearing users to comprehend” due to a lack of closed captioning, an alleged violation of the Americans with Disabilities Act (ADA).
The plaintiff, a legally deaf New York City resident, argues he and similarly situated individuals have been unlawfully denied the fully enjoyment of the facilities and content on BarstoolSports.com due to the site’s alleged accessibility barriers. According to the complaint, the man most recently attempted to watch a video titled “I Went Ghost Hunting with the Brooklyn Paranormal Society” but could not independently do so with the absence of closed captioning.
