Class Action Alleges Avvo Recorded Customer Phone Conversations Without Consent
Mitchell v. Avvo, Inc.
Filed: September 24, 2018 ◆§ 3:18cv2213
A class action alleges the online legal services marketplace broke California law by recording a telephone conversation without authorization or disclosure.
Avvo, Inc. is staring down a proposed class action lawsuit in which the plaintiff alleges the online legal services marketplace broke California law by recording a telephone conversation without authorization or disclosure.
Citing the California Invasion of Privacy Act (CIPA), the case says Avvo placed an advertisement call to the plaintiff in mid-August 2016. The man claims that at no point during the roughly four-minute phone call did he consent to having the call recorded, nor did the Avvo representative inform him of such.
The suit charges Avvo records all of its phone calls with customers and prospective customers in a similar manner.
Included in the proposed class are all individuals in California whose cell phone conversations with Avvo were allegedly recorded without consent.
