A NY resident has filed a lawsuit against The CBE Group in which she takes issue with particular language used by the company with regard to her balance.
A New York resident has filed a proposed class action against The CBE Group in which she takes issue with particular language used by the debt collector with regard to her balance. According to the lawsuit, the June 2017 communication stated the plaintiff’s “Current Balance” as $1,089.12. While the plaintiff was provided a “current balance,” the defendant allegedly failed to inform the woman that the amount may increase due to accrued interest, late charges, or other fees. Alternatively, if the woman’s balance was not accruing interest or late fees on the day she received The CBE Group’s notice, pegging her balance as “current” would be considered deceptive within the scope of the Fair Debt Collection Practices Act, the lawsuit argues.
