Defendant NPAS Solutions, LLC is on the receiving end of a proposed double-whammy class action alleging it violated both the Telephone Consumer Protection Act (TCPA) and the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims the defendant unlawfully used automated telephone dialing equipment to call consumers’ cell phones without first receiving express consent—an ostensible TCPA violation—for the purposes of attempting to collect debts. Upon information and belief, the lawsuit alleges the defendant routinely dials wrong or reassigned phone numbers that do not belong to the intended call recipients.
The plaintiff, a Florida man, claims the defendant called his cell phone on numerous occasions attempting to collect a debt owed by someone named Stephanie.
